Even if one could argue that one 'owns' the disk (If you bought it in box form) and, therefore, are entitled to an exchange due to the product being faulty.... that doesn't cut any mustard either as the disk itself is undamaged and the software on the disk is in the condition it was on release and, therefore, is not faulty. But surely if the game is as 'broken' as claimed then Steam would have no grounds to deny a refund, it's got nothing to do with the physical condition of the disk, back it all up with all the 'crash logs' you collected over the time and you have proof it doesn't work, the music comparisson doesn't work because at every music retail point you have the chance to listen to a sample so much more opportunity to research your purchase.
