Well, I can't really agree with you on that one, Feuerfalke.
Changing the publisher doesn't make it a new game.

If you write a book, you will probably need a publisher. If the cooperation with the publisher you normally use comes to an end, then you will have to find another publisher. You don't have to throw away what you have written because of that?
The same goes for a game developer. You will probably need a publisher. If the cooperation with UbiSoft goes down the drain, then you will have to find another publisher. But you don't delete the code you have produced because of this.

There might be an exception: If the old publisher has been financing the development of the new game, he might be the legal owner of the code. I don't think that it is the case here. But who knows?
