You don't HAVE to have any patches. 1946 DVD out of the box will fly fine. But, if you want all the latest official content (new aircraft, maps etc.) and some fixes to some issues, then yes, you need the patches.

The 1946 DVD version is 4.07. You first need to patch to 4.08, then to 4.09. You can't leapfrog 4.08.
