OP I think you're misunderstanding what DirectX is...

The patch being incompatible with DX9 just means it won't work for video cards that can only run DX9...

DirectX is an application programming interface that, in simplest terms, tells your hardware what to do when displaying images. The software you download on your computer when something requires DirectX will always be the most recent version, in this case DX11, but your hardware will only run at its maximum capable.

If you have a dated video card, like a GeForce 8600, you're stuck at DX9, a GTX 250 can run DX10 and DX9, a GTX 580 can run DX9, DX10, DX11 applications.

Cliffs of Dover has utilized DX10 for its best graphic settings and features, but to keep their audience wide as possible they've included a "DX9 mode" for people that don't have advanced video cards. This "DX9 mode" is automatically applied for people that cannot run the DX10 features...in this alpha patch that you're trying to run, DX9 is disabled, therefore anyone that cannot run the game in DX10 will not be able to run it, no matter what they do, except get a newer video card.

Revert back to the current version of CloD that is on steam if you wish to play the game right now. You can do this easily and quickly by right clicking Cliffs of Dover in your steam library>properties>somewhere in there is a "verify local game files" that will revert the patch.
