Please not as well: there is no suggestion here that the moderators are inefficient (so no grounds to get me into trouble) but rather my realistic perception that such a lack of objectiveness and fairness will always reap poor results.

Two thoughts:
1) Whatever his intent, it is the result that matters.
2) "I didn't know the gun was loaded" is not a viable defense.
He got what he deserved, even if he didn't think about the consequences of his actions.
It might have been a good joke, at some other time. But yesterday was not that time.
