How to get the XBOX patch
While dogfighting last night Pudgy came up with a good idea to pressure 505 to release the patch, instead of wasting time emailing 505, and getting no response, hit them where it hurts – in their bank account!
Lets call and email the major “game critics/news web sites, magazines, etc” (and this is where I need your help to pick the best ones) and let them know how us XBOX players have been unjustly left out of a required patch – that PS3 has already received! Lets get the word out there so every one knows how poorly 505 has been treating us and let them know that they don’t give a damn about their customer. Hopefully this will cause a backlash that will keep people from buying BoP and possibly boycotting all there products! This is how to “hurt” a company and force them to release the patch. This is just a basic rough idea and I welcome any and all ideas that will create pressure on 505 to release the patch. I salute all of you who have kept the faith. |

I have posted a thread on MS Xbox forum pointing out that 505 serve the interest of Sony conslole owners and and have refused to respond with any information concerning the xbox. I cannot imagine that MS will be too pleased with any publisher fixing common gameplay issues for one console only. I know that MS do read their hosted forums and often give replies to posts. Might not make any difference but at least its up on their forum for the Xbox cummunity in general to see just how we have been treated by 505.

Any company that prospers by relying on the public purchasing its goods should show some courtesy to its customers. The fact that 505 ignore all forms of correspondance is the issue here. We have relied in the DEVs not 505 for all information. The Devs, our source of information, are now gagged and 505 have effectively closed all lines of communication. I like where this is heading. I know it won't put them out of bussiness but at least we can put them in the spot light. Another route we may wish to pursue is posting on Consumer Complaint websites/blogs. Anything we can do to get the spot light on them. There are a bunch of them out there. I'd even hit up rip-off-report.com. I think the more negative press we can get going the better.
The trick is going to be keeping it professional. We do not want to sound like nagging 12 year olds or to come of as brutes. We need clean language and a defined purpose. (we want everyone that is posting to use the same message points) Of course I'm just tossing this out there but I think the best way to proceed would be to draft a clear message, defining what we want and why the current state of the game is not acceptable. Making reference to price points and that we have paid for a full game and only received half. Point out the patch debacle and how PS3 got it. Finally close out with a statement defining what resolution we want. Just my thoughts.... |

This would be a good thing for GameInformer to include in the "Good, Bad, The Ugly".
Especially when they could pull up multiple quotes promising things that never happened, and a total cease in communication. Very ugly. |
Heres a random idea that could work... (for uk players)
Send that thing on the xbox dashboard a message ("sent you a message" with them two clowns) they follow up any questions that they make public. Send them a message saying we have a loyal fan base that growns steadily weekly, because the ps3 got the patch etc etc and that we havnt got it, yet never heard from 505 and why we didnt get it because they blank us. Or... just write them some random crap and see if they do anything. Just an idea. |
I have contacted 505 games in the USA and UK, no response.
I suggest us Xbox 360 owners invade the yuplay forums for Wings of Prey and demand we get our patch for it. Let other people know that the developers will not support the game, will not reply to posts here, so what chance has the pc version got with the promises of title updates, fixes and new DLC. |

Think you have a valid argument there InfiniteStates. What is the relationship between 1C Company (who host this forum) and 505? Could 505 pull the plug on this forum (as well as 'gag' the devs) if they wish to do so?
I have read their corporate info and it appears that 1c are an independent publishing company but I could be wrong. |

If we are all in agreement for a post/letter drive I say we get this moving. I think we should come up with a list of bullet points for our letter/posts. Once we have that we will need an English Major or someone with strong grammar skills to put this together. (sorry I'm an IT guy) From there we can assign a couple of people to do the postings. (if we are mailing, I say the more the merrier, I can host a word doc online for everyone to access to print and send) We should also come up with a list of sites we want to send this to... both posts and emails.

I wonder if we have any legal options, considering we paid the same amount of money for the game and yet have received an inferior product. If we don't have any legal options, I wonder if Microsoft would.
Imagine if this same situation were to be happening with a blockbuster like MW2... there is no way Microsoft would allow it's game to be shortchanged Maybe we should take this fight to Microsoft. |
I intend to do that. If the MS Xbox thread I created gets the support I will contact them, refer them to that thread on their forum and ask for their response/views.
It may come to nothing but the more ammo we collectively dish out the better the chances of an MS intervention or possibly some background help. |

SEE- when posting on other sites, you need to take the time and realize that your message is being heard by people that know nothing about the game, you didn't really mention the time frame upon which the ps3 got the patch and xbox still doesn't have it (about a month and a half).
Good luck on getting results published in magazines/articles/etc... Ps.-- Lol, Gunny, nobody really tells you this, but most people that post on forums re-read their post atleast once to make sure it makes sense, it's not about grammar, it's about showing you care enough to make your message heard. Not proofreading means you don't really care enough, which is acceptable when texting/emailing girls and such, but not really appropriate in a forum sense, stop trying to appear as someone that's too busy, that's a lame excuse that no one believes anymore these days. |

I had similar comments on the Xbox thread so point taken Deascendant and a worthwhile observation.
I don't mind working on a draft for the forum and will try to be consice and relevant to the problems we are experiencing with 505. One thing I have noticed embedded in Antons replies are the Devs feelings of disappointment with this sorry affair. It seems, reading through Antons replies, that the main issue from the publishers perspective were the technical problems on the PS3 rather than 'game improvements'. The Devs appear to have gone beyond resolving those technical issues by adding gameplay improvements across both platforms. In one post he states that the publishers were aware that the updates also improved gameplay but also seems to suggest that they were satisfied with the gameplay (on the release version) but submitted the PS3 update as delivered. That may explain why, in a later reply, they (the devs) also fail to get replies from 505 following the release of the PS3 update. The Xbox argument is really confined to two issues:- 1. Failure of 505 to communicate its commitment to the Xbox platform. 2. The release of the PS3 update has resulted in a superior product with improved gameplay for PS3 despite access to, and ownership of, the software update to redress this for owners of the Xbox. (there are no technical or hardware limitations) |

Kudos to all the great pressure tactics people are coming up with. I can't believe the hoops we have to jump through just to get treated the same as PS3 users. Following the statement from 505 which cleverley addresses two issues we have with them:-
1. Failure to communicate with its customers. 2. Lack of committment to the Xbox platform following the release of the PS3 Title update. We are investigating the development of a X360 patch and appreciate the importance of continuously evaluating and improving the game play experience. Although I am unable to confirm if and when this will be available, we will certainly update the community as soon as we know. It's a non commital reply as to whether a patch will be released but the use of the word 'development' suggests that a patch was never submitted or completed for the Xbox. Somehow we need to get the evidence that they have the patch and it was submitted to them some time ago. Reading through Antons previous comms suggets that they did submit it Can we prove that and how? We have to maintain the pressure on 505 by shifting the argument to another issue otherwise they will simply continue to respond with the same non-commital reply. If anyone has access to all of the devs responses, particularly those that state the patches were completed and submitted to 505 and time frames............post them here! We have to challenge their use of 'Investigating the development' in that statement. |

Here is what I wrote (let me know if anyone thinks it needs to be changed somehow): "In early 2010, 505 Games has been criticized by customers for failing to release a game-fixing patch for the Xbox 360 version of IL-2 Sturmovik: Birds of Prey, even though the same patch was released for the PS3 version. Comments by the developers of IL-2 Sturmovik: Birds of Prey reveal that the patch has reportedly been finished but has been sitting in limbo for months awaiting approval.[1]" I would be appreciative if people out there who are trying to help with this issue could keep an eye on that Wikipedia page every once in a while to make sure 505 games (or some other anal Wikipedia editor) hasn't removed that bit, and to add it again if they do. |
Need to refer and quote the relevant statements (from the devs) to support the argument that 505 are already in receipt of, or have access to, a Xbox Patch that addresses common game improvements. Otherwise it's an assumption (or claim) that can be questioned.

Thats the post i was referring to (but couldnt find) in another thread pope when i replied to one of your posts.
The patch was done and was sent, though it was supposedly microsoft who sent the patch back/refused it because it had issues still, where as the PS3 patch did not. So BOTH patches were put on hold until the 360 patch was sorted, but they didnt fix it and ended up only releasing the PS3 patch, letting the 360 version rot. To much time and effort to fix it for them. Its mroe about money, not the customer. Were just the pawns in their little game. One day they will realise they need us though lol. |

The 505 statement of intent seems to be well and truly contradicted and ultimately discredited by the response of Anton in that thread. We fight on........pawns? ...maybe, but can still get a king in checkmate!

Costs Associated with Patch Release
Found this article. Says developers get charged for releasing a patch through Sony but not with Microsoft. Unless I am reading this wrong this makes little sense they would release a patch to Sony first since it would cost them to do so. If this is the case then I suspect other issues are delaying or stopping the 360 patch.

This could all point back to the surcharge on downloads that Sony began implementing on PSN downloads back in October, 2008, around the time Fallout 3 was released. Since then Sony has charged developers $0.16/GB for content downloaded through PSN. Even content that’s free, like the Fallout patches, would be subject to the charge for the first 60 days that the content is out. Paid content would be subject to the fee as long as there’s a charge associated with it. This could also be why we haven’t seen the major Fallout 3 expansions on the PS3 either. Operation: Anchorage released on January 27, 2009 for 800 Microsoft Points, The Pitt ended up having a broken release in March for the same point value and the 3rd content pack, Broken Steel, will be out in May. So far none of these expansions are even announced for the PS3 and the reason could be simple mathematics. On the Xbox Marketplace it shows the file sizes for both Operation: Anchorage and The Pitt. Combined they make up 861 MB. Given Sony’s $0.16/GB fee for downloads that means any user who downloaded both of them would cost Bethesda $0.14 (assuming a pro-rated schedule). So, hey, you say to yourself, fourteen cents isn’t that big of a deal. Until you realize that there are potentially more than a million downloaders. That $0.14 rapidly balloons to $194,600 if all 1.39 million PS3 players download both updates. Even if we’re to be conservative and say that only 500,000 people download both packages, that still represents an extra $70,000 to be carried by Bethesda. In the face of this there is simply no incentive for developers to release their products for download on the PS3: better to wait and do a “Game of the Year” package or something similar and avoid losing profits and dev costs to what is effectively a “download tax” that is not attached on competing platforms – in the meantime forcing game owners to pay for another full game that includes the extra content." |

Why on earth don't 505, and all involved, communicate their their point of view? I think most of us would be disappointed if it was a financial constraint that prevented any possibilty of a patch but I also think most of us would give more respect to the publishers. We could even offer to pay for a decent upgrade in the form of a DLC . OK, contentious may be and pretty sure some would object but an option non the less!

No suprises there and just goes to show that even MS are not the slightest bit interested in supporting us to support their console. Gamers need their own independent website to air grievences with Console manucturers and Publishers. I would be interested to know the reasons for deleting it.
